Contrato indefinido, alta direccion and the Spanish digital nomad regime

Senior Spanish hires are typically engaged on a contrato indefinido (open-ended employment contract) governed by the Estatuto de los Trabajadores and the relevant convenio colectivo. C-level roles (CEO, COO, Director General) are usually engaged under the special alta direccion regime (Real Decreto 1382/1985), which carves out a different notice, indemnity and termination framework from the ordinary Estatuto. Standard senior notice in Spain ranges from one month at Director level to three months at VP level, with the alta direccion regime allowing tailored notice and indemnity by mutual agreement.

Termination of a Spanish senior hire is governed by indemnizacion por despido improcedente (33 days per year of service for post-2012 service, capped at 24 months) where the dismissal cannot be objectively justified, and by the lower indemnizacion por despido objetivo (20 days per year, capped at 12 months) where it can.
